Please read these Terms and Conditions (the "Terms") carefully. They govern your ("user(s)," "you," or "your") access to and use of the Pocket Technician website (the "Site"), software platform, content, and related services (the "Services"). By accessing or using the Services, you agree to these Terms and enter into a legally binding agreement with Pocket Technician ("Pocket Technician," "Company," "we," "us," or "our").
- Eligibility and User Accounts
- To use our Services, you must be at least 18 years old or the age of majority in your jurisdiction, or 13 years old with parental consent. By creating an account, you agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
- User Categories
- Homeowners. Homeowners engage with Pocket Technician's AI-powered chatbot ("AI Agent") to describe HVAC-related issues and receive step-by-step suggestions, scheduling information, and troubleshooting insights. The AI Agent is trained on data provided by licensed HVAC professionals but is not itself a licensed human technician. By using the chatbot, homeowners acknowledge:
- The AI Agent does not provide certified or licensed HVAC advice
- All work must be performed by a licensed HVAC professional
- Pocket Technician is not liable for any harm, damage, or injury resulting from attempts by homeowners to conduct self-repairs
- HVAC Contractors. Contractor users, including Customer Service Representatives and Operations Managers, access Pocket Technician's dashboard tools for reporting, analytics, and CRM-integrated communications. They are responsible for maintaining confidentiality of all customer data accessed through the system and must:
- Use the platform only for internal business purposes
- Ensure that data shared via API is accurate and authorized
- Comply with relevant data protection and privacy regulations
- Homeowners. Homeowners engage with Pocket Technician's AI-powered chatbot ("AI Agent") to describe HVAC-related issues and receive step-by-step suggestions, scheduling information, and troubleshooting insights. The AI Agent is trained on data provided by licensed HVAC professionals but is not itself a licensed human technician. By using the chatbot, homeowners acknowledge:
- Services Overview
- Pocket Technician provides a SaaS platform for the HVAC industry, offering tools for system diagnostics, call optimization, prioritization, scheduling, and dispatching. The platform includes an AI-powered chatbot built on Google Dialogflow that interacts with homeowners and collects personal information, including name, address, phone number, and HVAC model number, to facilitate services.
- Data Privacy and Use
- By using our Services, you consent to the collection and use of personal information as described in our Privacy Policy, available at pocket-technician.com/terms. Data provided by users through the chatbot or otherwise is used solely to deliver and improve Services. You retain all rights, title, and interest in the data you submit through our Services. However, by using the Platform, you grant Pocket Technician a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, copy, analyze, and process such data for the purpose of improving and enhancing our Services and technology. Pocket Technician does not sell user data and will not use it for purposes unrelated to service delivery.
- API Integrations
- Pocket Technician provides bi-directional API access to HVAC contractors' Field Service Management CRMs. This includes:
- Accessing customer data, service history, and notes
- Pushing homeowner-collected data, scheduling outcomes, and reports into the contractor’s CRM
- Booking and confirming service appointments directly in the CRM
- Contractors must expressly authorize this integration and are solely responsible for the integrity of their CRM data. Pocket Technician is not liable for scheduling conflicts, CRM outages, or data discrepancies resulting from third-party platforms.
- By using our APIs, you agree not to:
- Use the APIs in excess of reasonable or documented rate limits
- Reverse engineer, modify, or interfere with the functionality of the APIs
- Use the APIs to develop or support any competing product or service
- Share, sublicense, or disclose API credentials without prior written consent
- Pocket Technician reserves the right to suspend or revoke API access in the event of misuse, abuse, or interference with platform stability. Additional technical or usage guidelines may be published separately and are considered incorporated by reference.
- Pocket Technician provides bi-directional API access to HVAC contractors' Field Service Management CRMs. This includes:
- Restrictions and Acceptable Use
- You agree not to:
- Use the Services for any unlawful, fraudulent, or abusive purpose
- Attempt to gain unauthorized access to any system, account, or data
- Introduce viruses, malware, or any other harmful code into the platform
- Interfere with the operation, performance, or security of the Services
- Scrape, copy, or extract platform content or data without written consent
- Use the platform to build, support, or promote a competing service
- Share your login credentials or allow unauthorized third-party access
- Pocket Technician reserves the right to suspend or terminate your access to the Services for any violation of this section, with or without prior notice.
- You agree not to:
- Service Availability and Modifications
- We reserve the right to modify or discontinue the Services at any time without notice. We are not liable for service interruptions or downtime.
- License Grant
- Subject to these Terms, Pocket Technician grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your personal, non-commercial use (if you are a homeowner) or internal business operations (if you are a contractor), and only as permitted by your access rights and subscription. All rights not expressly granted to you are reserved by Pocket Technician.
- Payment and Transactions
- If you access any paid services or features of the Platform, your use and payment obligations will be governed by a separate agreement between you and Pocket Technician (such as an Order Form or subscription plan). You agree to provide accurate billing information and to comply with the payment terms stated therein.
- Intellectual Property
- All content and software provided by Pocket Technician are the property of Pocket Technician or its licensors. Users retain ownership of content they provide but grant Pocket Technician a license to use it as necessary to provide Services.
- Support
- Pocket Technician provides support via email during operating hours from 8:00 AM to 5:00 PM Pacific Standard Time (PST), Monday through Friday. There are no uptime guarantees or formal service level agreements (SLAs) at this time.
- Limitation of Liability
- Pocket Technician provides the Services "as is" without warranties of any kind. We are not liable for damages resulting from your use of the Services or from any decisions made based on system diagnostics or chatbot interactions.
- Indemnification
- You agree to indemnify and hold Pocket Technician harmless from any claims arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
- Termination
- 13.1 Homeowners. These Terms apply continuously to homeowner users by virtue of accessing or using the Services. No explicit termination process is applicable.
- HVAC Contractors. HVAC contractors enter into annual evergreen contracts that auto-renew each year. Either party may terminate the agreement with at least sixty (60) days’ written notice before renewal. Pocket Technician may terminate contractor access for violations of these Terms or legal obligations.
- 13.1 Homeowners. These Terms apply continuously to homeowner users by virtue of accessing or using the Services. No explicit termination process is applicable.
- Dispute Resolution
- You and Pocket Technician agree that any claims or disputes shall be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
- The arbitration shall take place in Orange County, California, and judgment on the arbitration award may be entered in any court having jurisdiction. You agree that any disputes arising from or relating to these Terms or the Services shall be subject to arbitration in this venue, and you waive the right to participate in any class action or representative proceeding
- Governing Law
- These Terms shall be governed by the laws of the State of California, without regard to conflict of laws principles.
- Changes to These Terms
- We may update or modify these Terms and Conditions at any time, at our sole discretion. For material changes, we will provide at least 30 days’ notice by posting an update on our website or notifying you through other reasonable means. Your continued use of the Services after such notice constitutes your acceptance of the updated Terms.
- Privacy and Subprocessors
- Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your personal data. By using the Services, you consent to the practices described in that policy.
- We may rely on trusted third-party service providers (“subprocessors”) such as Google Cloud and Google Dialogflow to operate portions of our Services. These subprocessors are contractually bound to protect your data and may only use it to support the delivery of the Services.
